Welcome to FB Catering DMCC (“we,” “us,” or “our”). By accessing or using our website soyummy.ae (the “Website”) and the services provided through it, including ordering meal plans, you agree to comply with and be bound by these Terms and Conditions (“Terms”). Please read these Terms carefully before using our services.

1. Use of the Website

By using our Website, you represent and warrant that:

• You are at least 18 years old, or if under 18, you have the permission of a parent or legal guardian to use our services.
• You will provide accurate, complete, and current information during the registration and order process.
• You will not use our Website for any illegal or unauthorized purposes, including any actions that may harm, interfere with, or disrupt the Website or its services.

2. Meal Plans and Orders

2.1. Allergies

At So Yummy, we take allergies seriously and aim to provide clear information to help you make informed decisions. 

While all our meals are prepared in a nut-free kitchen, some dishes may include common allergens such as milk, wheat/gluten, soy, fish, celery, or eggs. If your child has a severe allergy to any of these ingredients, we strongly recommend avoiding our products.

We encourage parents to carefully review the ingredient lists that will be labeled to each meal. If your child has any unique or severe dietary restrictions, please consult your pediatrician for guidance before introducing new foods.

2.2. Placing Orders

When you place an order on our Website, you agree to the following:

• You are responsible for providing accurate delivery information.
• All orders are subject to availability and acceptance by us. We reserve the right to refuse or cancel orders at our discretion, including cases where product availability, pricing errors, or fraudulent activity is detected.
• You will be notified of any issues with your order and offered alternatives or refunds if necessary.

2.3. Modifying or Cancelling Orders

Once you have submitted an order, it may not be possible to modify or cancel it. If changes or cancellations are necessary, please contact us as soon as possible through the contact details mentioned in the Website, and we will do our best to accommodate your request.

3. Prices and Payments

3.1. Pricing

• All prices displayed on our Website are in AED and are inclusive of applicable taxes unless otherwise stated.
• We reserve the right to change the prices of our meal plans and products at any time. However, price changes will not affect any orders that have already been confirmed.
• All customers must pay a refundable deposit of AED 150 for the Chiller Bags and ice packs used for delivery before starting their meal plan. This deposit will be refunded within 10 business days. 

3.2. Payment

We accept payments through multiple means such as credit cards, debit cards, Google Pay and Apple Pay. By placing an order, you authorize us to charge the provided payment method for the total amount of your order.

• If payment fails, we reserve the right to cancel your order or suspend your subscription until payment is successfully completed.

4. Delivery

• We aim to deliver meal plans to the address you provide during the order process within the estimated delivery timeframes. However, delivery times are estimates and may vary due to unforeseen circumstances.
• We are not responsible for delivery delays caused by factors beyond our control, such as weather conditions, natural disasters, or third-party carrier issues.

5. Refunds and Returns

5.1. Refund Policy

We want you to be satisfied with your meal plan orders. If you encounter any issues with your order, please contact us within 24 hours of delivery. Refunds or replacements will be issued at our discretion for the following reasons:

• The meal plan or product is damaged or not as described.
• Delivery issues that are caused by us.

5.2. Non-Refundable Items

Due to the perishable nature of our products, we do not accept returns or issue refunds for:

• Meals that have been consumed or partially consumed.
• Customer preference or change of mind after delivery.

6. Intellectual Property

All content on the Website, including text, images, logos, and software, is the property of FB Catering DMCC and is protected by applicable intellectual property laws. You may not copy, distribute, modify, or reproduce any part of the Website without our express written consent.

7. Limitation of Liability

To the fullest extent permitted by law, FB Catering DMCC shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of profits, loss of data, or damages resulting from the use or inability to use the Website or services, even if we have been advised of the possibility of such damages.

Our liability for any direct damages arising out of the use of the Website or services shall be limited to the total amount paid by you for the specific meal plan order or subscription in question.

8. Indemnification

You agree to indemnify and hold harmless FB Catering DMCC, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from or related to your use of the Website or violation of these Terms.

9. Changes to the Terms and Conditions

We may modify these Terms from time to time to reflect changes in our services, practices, or applicable laws. When we do, we will post the updated Terms on the Website and update the “Effective Date” at the top. Your continued use of the Website after any changes to the Terms constitutes your acceptance of the updated Terms.

10. Governing Law

These Terms and any disputes arising from your use of the Website or services shall be governed by and construed in accordance with the laws of the United Arab Emirates.
